These are not directly or indirectly involved with the vendors. Vendors here are referred as vendors and packers & movers. User are as the one who are taking the service.

Services Offered by us

The company services include transportation or complete packing and moving, unpacking, mortgage, survey, inspection, labour/manpower and other related services only under ShiftingWale trademark. We are a platform to provide various choices of Vendors based on your requirement description and budget. We are not directly or indirectly involved in providing transportation services. We only provide a website to both the User and the Vendor where the user chooses one of the vendor out of the list displayed on the Website. As an order is placed or a request is sent to us on http://www.shiftingwale.com/ for hiring the services of the vendors as mentioned above, we will make available the list of Vendors and Packer and Movers listed on our website along with the quotations as per the requirement of yours. You, as per your wish, may book any of the vendor and the vendor will initiate its service. You are liable to pay the charges to us or the Vendor as the case may be in the manner as laid down in Foregoing Paragraphs.

Terms and conditions

Your Account: If you use the website, you are responsible for maintaining the confidentiality of your account and password for restricting access of your Gadget to prevent an unauthorized access of your account. You are liable for all activities that occur in your account. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any doubt that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner.

License for Website access

ShiftingWale grants you a limited license to access and make personal use of this website, but not to download (other than page caching) or modify any portion of it, except with express written consent of ShiftingWale and / or its affiliates, as may be applicable.This license does not include any resale or commercial use of this website or its contents; any collection and use of any service listings, descriptions, or prices; any derivative use of this website or its contents; any downloading or copying of account information for the benefit of another party; or any use of data mining, robots, or similar data gathering and extraction tools.

Rights and liabilities inter-se User and Vendor

It is hereby reiterated that our role is limited to the extent of providing a platform for both the user and the vendor where the user can have options to book any of the vendor to avail of its service (as per the T&C) and similarly the vendor can expand its business by having an exposure to various user and their requirements.We make few coordination communications between the user and vendor for proper facilitation of user but these communications do not make vendor an agency of ours.We are not vicariously liable for any of the deeds and acts of the vendor.We do not guarantee any error/damage/delay free service to the User and ultimately it is the Vendor who is responsible for provision of proper, safe and timely services.

Restrictions and Prohibitions

Users shall not use any content in order to host, display, upload, modify, publish, transmit, update, distribute, share, store or destroy material, including without limitation ShiftingWale content, in violation of any applicable law or regulation, in a manner that will infringe the copyright, trademark, trade secret or other intellectual property or proprietary rights of others or violate the privacy, publicity or other personal rights of others.That belongs to another person and to which the user does not have any right to.That is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of others privacy, threatening, abusive or hateful or racially, ethnically objectionable, disparaging, relating encouraging money laundering or gambling or otherwise unlawful in any manner whatsoever harm minors in any way.

Disclaimer of Warranties/Limitations of Liability

We have endeavoured to ensure that all the information on the Website is correct, but we neither guaranteed you regarding the quality of Transportation services as provided by the Vendors.In no event shall we be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages resulting from: (a) the use or the inability to use the Website;(b) unauthorised access to or alteration of the users transmissions or data;(c) any other matter relating to the use of website including, without limitation, of or failure to provide any information, software, products, services and related graphics obtained through the Website, or otherwise arising out of the use of the website, whether based on contract, tort, negligence, strict liability or otherwise.

Indemnification

You agree to indemnify, defend and hold harmless us from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by us that arises out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these Terms.

Damages

The carrier or their agent shall be exempted from loss or damage through accident, pilferage, fire risk, collision any other road or river hazard, we therefore recommend that goods be insure under carrier's risk. While carrier's, no individual policy/receipt from insurance the co. will be given. ShiftingWale will not be responsible for any kind of loss or damage's.

Delay

Time duration for delivery of the shipment given by ShiftingWale is after loading and we are also not liable for any delay in the shipment due to any cause.If any Labour Union issue/natural disaster/strike/government issue arises than the amount will be beard by Customer itself.

ShiftingWale is Not Termination

We may suspend or terminate your use of the Website or any of our Services if we believe, in our sole and absolute discretion that you have breached any of the Terms.If you or we terminate your use of the Website or any Service, we may delete any content or other latest services of ours so that he/she becomes duly aware of any change's in our policies.

Payment

On approving a quotation from us. The client will receive a confirmation form where he/she will fill up the form and also accept our terms and conditions.After the pick-up of the shipment an invoice will be generated which will include all types of direct taxes.

Cancellation Fee

Cancellation can be done 48 hours before the time of pick-up. And refund will be done through online mode within 7-8 working days.

Indirect taxes will be applicable

Quotation inclusive of all direct taxes.Please be advise that the lorry transportation charges, which quoted, are the present prevailing rates will be charged on actual at the time of transportation. Octroi, charges.If applicable will be charged extra as per actual in advance.Which is with-in 48Hrs after the pick-up of the shipment.
We would request you to pay us 100% of all charges in advanced on completion of the packing at loading point.For insurance the full amount of the premium value to be paid of the consignment.Please note that the above quotation was prepared keeping in view, our basic standard of packing with the best material, as the type of packing will be fit to our discretion.
